Terms of Sale: Refurbished Devices

Please read the following terms and conditions carefully before purchasing a refurbished device from Bendigo Smartphones (“we”, “us”, “our”). By completing your purchase or signing below, you (“the purchaser”) agree to these terms.

1. Product Definition & Condition

  • Refurbished Nature: You acknowledge that the device you are purchasing is not brand new. It has been previously owned and restored by our technicians to working condition. It may contain a mix of original and high-quality aftermarket parts.
  • Cosmetic Condition: The device is sold "as is." You confirm that you have inspected the device in-store and are satisfied with its physical condition, including any visible scratches, dents, or wear. We do not accept returns for cosmetic defects identified after the device has left the store.
  • Water Resistance: Due to the nature of refurbishment and prior repairs, we cannot guarantee the original water resistance (IP rating) of this device. You should treat the device as not waterproof.
  • Battery Health: Batteries are consumable components. While we ensure batteries are functional at the time of sale, they may not hold the same capacity as a brand-new device.

2. Pricing & Payment

  • Final Price: The price agreed upon is final and includes GST.
  • Payment Methods: Payment must be made in full at the time of purchase. We accept cash and major credit/debit cards. We do not accept personal cheques, bank transfers (unless cleared prior to collection), or unauthorized payment plans.
  • Ownership: Legal title and ownership of the device transfer to you only upon full payment. Risk of loss or damage passes to you immediately upon physical handover of the device.

3. Warranty & Consumer Rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).

  • Voluntary Warranty: In addition to your ACL rights, this device comes with a 6-Month Warranty covering defects in materials and workmanship.
  • Exclusions: This warranty does not cover:
    • Physical damage (cracks/drops).
    • Liquid damage.
    • Software issues or bugs caused by updates.
    • Tampering (opening the device) or repairs by third parties.

4. Returns & Refunds

  • Change of Mind: We do not offer refunds or exchanges if you simply change your mind, find the item cheaper elsewhere, or decide you don't like the model.
  • Faulty Goods: If the device has a major failure not caused by misuse, you are entitled to a refund or replacement in accordance with Australian Consumer Law.

5. Data Transfer & Privacy

If you request assistance transferring data from an old device to this new one:

  • Risk of Loss: We take all reasonable care, but data transfer involves inherent risks. Bendigo Smartphones is not liable for any data lost during the transfer process.
  • Privacy: Any credentials (passwords/PINs) provided to facilitate the transfer are not stored and are used solely for the purpose of the setup.
  • Trade-Ins: If you are trading in an old device, it is your responsibility to back up your data. Once traded in, the device will be wiped, and data cannot be recovered.

6. Limitation of Liability

To the extent permitted by law, Bendigo Smartphones is not liable for any indirect or consequential loss (such as loss of profit or data) arising from the use of this device. Our liability is limited to the refund of the purchase price or replacement of the device.

7. Governing Law

These terms are governed by the laws of Victoria, Australia.
